Technical Assistance to the Ministry of Environment to Ensure Compliance with Environmental Impact Assessment (EIA) Directives, Romania

This project involved international and Romanian experts from PM in providing advice and assistance to the Ministry of Waters and Environmental Protection (MoWEP) and its affiliates. The project developed expertise and know-how in the implementation and enforcement of the Environmental Impact Assessment (EIA) Directives as part of pre-Accession strategy for Romania.

The project focused on:

  • Reviewing the institutional framework, capacities, systems and personnel of the Ministry and its affiliates.
  • Developing the institutional framework and capacity for applying EIA procedures at central and local/regional level.
  • Reviewing and identifying non-compliance points of Romanian legislation with EIA Directives. This task focused on all levels of Romanian legislation, including Ministerial Orders.
  • Drafting enabling legislation (Government Decisions, Ministerial Orders and rules and regulations pertaining to the organisation and operation of MoWEP) to empower each regulatory administrative unit at central and regional level, including Municipalities.
  • Developing procedures and administrative processes for administration of the EIA Directive in Romania.  This included a handbook for officials at central, regional and local levels.
  • Enforcement, financial planning and identification of needs: estimation of costs of implementing EIA and development of financing plan for each action; development of charging system to cover the cost of public administration costs of implementing the EIA Directive.
  • Raising awareness and public participation, including the development of a PA strategy, communication messages, web page and publication of a booklet and brochure.
  • Training: seminars and workshops to develop skills for implementation of the Directive at central and regional levels.

  • Functional review to address overall capability, structures, budgetary techniques, management, human resource capacity, and readiness for Acquis;
  • Evaluation of current central and regional institutional structures and developing a framework for optimum implementation and enforcement of the EIA Directive;
  • Development of procedures and administrative processes;
  • Economic and financial analysis of implementation plans involving central and regional bodies;
  • Legal compliance analysis and development of ‘tables of concordance’;
  • Support to Legal drafting (primary and secondary legislation);
